Privacy

Policy:

Koomarri will ensure that personal information is collected and handled in a manner that is consistent with the principles set out by the Office of the Federal Privacy Commissioner and by the relevant Acts.

Collection:

  • Koomarri will only collect information that is relevant to the needs of service provision for the individual. Koomarri will always endeavour to obtain personal information directly from the individual/advocate/family concerned.
  • In collecting personal information Koomarri will take all reasonable practical steps to ensure the individual/advocate/family knows:
    • Why the information is being collected.
    • What the information is being used for.
    • How the information will be stored and where.
    • Who has access to the information and why.
    • How the individual/advocate/family can access the information held.
    • Any other legal requirements governing the collection and handling of personal information.

Quality:

  • Koomarri will take all reasonable practical steps to ensure that the personal information it uses is accurate, complete and up to date.

Security

  • Koomarri will take all reasonable practical steps to protect all personal information in its possession, and ensure the integrity of the information.
  • All personal information will be kept in designated locked cabinets.
  • Personal information that is no longer needed by Koomarri, nor required to be held by law, will be destroyed by secure means, or modified so that data cannot be traced back to the individual concerned.

Access:

  • Only those staff that have direct authority by Koomarri to access the relevant personal information may do so.
  • An individual (or duly authorised person) whom Koomarri holds personal information on may apply, in writing, to gain access to that information by completing the appropriate access form and addressing it to the relevant section manager.
  • Koomarri will take all reasonable practical steps to confirm the identity of the person making the request, and will respond within 14 days of receiving the request.
  • Any third party information held on an individual’s file can only be released to that individual (or duly authorised person), only after the third party has given the appropriate approval.
  • Koomarri reserves the right to deny access to personal information, if by providing access:
    • Could pose a possible threat to life or health.
    • Could cause an unreasonable impact on the privacy of others.
    • Would be in response to a frivolous or vexatious request.
    • Relates to existing or anticipated legal proceedings which could be prejudiced as a result.
    • It is in any way unlawful.
    • Could in any way prejudice law enforcement or security.
    • Could prejudice the prevention, detection or investigation of seriously improper conduct, either within or external to Koomarri operations.

Use:

  • Koomarri will only use or disclose personal information for the purpose(s) originally explained when the information was collected, and for any related purpose that would reasonably be expected by both the individual/advocate/ family concerned and Koomarri.

Identifiers:

  • Koomarri will not use an identifier assigned to an individual by a Government Agency as its own identifier, nor will it provide such an identifier to a third party without the individuals consent, unless:
    • Disclosure is necessary for Koomarri to fulfil its obligations to the agency.
    • It is required for health or other emergency reasons.
    • It is required to investigate suspected fraud or unlawful activity.
    • It is required or authorised by law.
    • It is required for law enforcement.

Sensitive Information:

  • Koomarri will not without the consent of the individual/advocate/family (duly authorised person), collect information concerning that individual’s racial or ethnic origins; political opinions; membership of a political, professional or trade association or trade union; philosophical or religious beliefs or affiliations; sexual preferences or practices or health information unless:
    • It is required by law.
    • It will prevent or lessen life or create health threatening situations.
    • It is not possible or practical to gain the individual's consent.
    • The collection is necessary in relation to a legal or equitable claim.

Complaints:

  • Complaints about any aspect of Koomarri's management of their personal information should be directed in writing, to:
